BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located in the 5500 block of Hixson Pike, being on the southeast line of Hixson Pike southwest of Clear Creek Road. Lots 1 and 2, Cash Construction Company Subdivision, as shown by plat of record in plat book 48, page 24, ROHC; being part of the property described in deed book 2930, page 178, ROHC. Said lots form two tracts, the first tract (to be zoned C-2) begins on the southeast line of Hixson Pike some 457 feet southwest of the intersection of the southeast line of Hixson Pike with the northwest line of Clear Creek Road, said point being the northeast corner of lot 2, said Cash Construction Company Subdivision, thence southeast some 224 feet with the northeast line of said lot 2 to a point 200 feet (if measured at a right angle) southeast of the southeast line of Hixson Pike, thence southwest 230 feet parallel to, and at all points 200 feet southeast of, the southeast line of Hixson Pike to a point in the southwest line of lot 1, said subdivision, thence northwest some 224 feet with the southwest line of said lot 1 to the southeast line of Hixson Pike, thence northeast 230 feet with Hixson Pike to the point of beginning. To find the true point of beginning of the second tract, start on the southeast line of Hixson Pike some 457 feet southwest of the intersection of the southeast line of Hixson Pike with the northwest line of Clear Creek Road, said point being the northeast corner of lot 2, said Cash Construction Company Subdivision, thence southeast some 224 feet with the northeast line of said lot 2 to a point 200 feet (if measured at a right angle) southeast of the southeast line of Hixson Pike, the true point of beginning, thence continuing southeast some 342.78 feet with the northeast line of lot 2 to the northwest line of Clear Creek Road, thence southwest 205.77 feet with Clear Creek Road to the southwest corner of lot 1, said subdivision, thence northwest some 259.81 feet with the southwest line of said lot 1 to a point 200 feet (if measured at a right angle) southeast of the southeast line of Hixson Pike, thence northeast 230 feet parallel to, and at all points 200 feet southeast of, the southeast line of Hixson Pike to the northeast line of lot 2, the true point of beginning. Tax Map No. 100K-B-8.7 and 8.8. from R-2 Residential Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 0C 1. Leaving 25' R-2 buffer along Clear Creek Road; 2. No access to Clear Creek Road; 3. Natural site-obscuring screen along the south side of the property in accordance with the provision of the M-3 zone; and 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as required by law.
